CA Budget Update - July 28, 2009

The original 2009-2010 Budget allocated $108 million in Proposition 36 programs: $90 million for Proposition 36 specifically, and $18 million for the Offender Treatment Program (OTP). The $90 million in funding for Proposition 36 has been eliminated for the 2009-2010 Budget Year. The $18 million in funding for the OTP continues in the 2009-2010 Budget Year. Additionally, a one-time increase in federal Byrne JAG grants will provide a $50 million augmentation in funding for OTP in the 2009-2010 Budget Year. In total, the funding was reduced by $40 million (from $108 million to $68 million) and was identified to be solely for the OTP to allow the Legislature more control over the policy of the program.

SB 707 - Final Status

Dear CAADAC and Constituents,

Unfortunately this is to inform you that SB 707 did not make it out of appropriations committee.   If it weren't for the dismal financial situation of California, licensure may have become law this year.  However, the dire fiscal state of California is tenuous and budget cuts are the priority of our state leaders. 
 
I would like to acknowledge the California Department of Alcohol/Drug Programs (ADP) Director Zito and staff for their hard work and dedication to increase standards for our profession and ensure consumer protection. 
  
CAADAC's long-standing message regarding the need for higher standards has been heard by loud and clear by legislators and is now being echoed by other professional organizations, including ADP as demonstrated by this legislative attempt. Most believe it is only a matter of time before this specific type of legislation will become a reality.  We will continue to explore our options and will continue the tremendous progress we've made toward our mission.

SB 707 Update: May 13, 2009

SB 707 was heard by the Appropriations Committee on May 11, 2009. The committee placed the bill into the suspense file.  This means the bill will be reviewed for the fiscal impact while in suspense.  The suspense process can take anywhere from 1-4 weeks.  The committee will review the impact and determine whether or not to move the bill to the next committee. (There will not be any testimony during the determination process.)  I will keep you updated throughout the legislative process.

SB 707 will be heard in the Appropriations Committee on May 11, 2009. The hearing will commence at 11:00 am in Room 4203 of the State Capitol in Sacramento CA. (The State Capital building is located on 10th and L Street.)  This hearing does NOT include testimony from contituents; but you are welcome to attend.

SB 707 was heard at the state capitol today at approximately 4:45pm. After listening to testimony from those in favor and those opposed; the committee voted  in favor of moving the bill to the next step in the process.  (7 aye votes against 2 nay votes.)

Thank you for the hard work you put forth daily to serve those suffering with substance abuse disorders. I appreciate your professionalism, work ethic and mostly your integrity in upholding the highest standards of certification in California.

Many of you may be receiving confusing messages about Senate Bill 707 (DeSaulnier’s counselor licensing and certification bill). The challenges we faced in dealing with negative scrutiny was apparent in regard to our (similar) bill last year. These messages seem to be an attempt to derail the Department of Alcohol and Drug Program’s efforts to pass legislation to create higher standards for our profession. Please avoid being pressured, swayed or fearful by misinformation and scare tactics.

Member Update: NAADAC Affiliation - The End of an Era

Dear Fellow CAADAC Members:

Due to a very unfortunate set of circumstances, the CAADAC Board voted on Thursday to stop collecting and sending NAADAC dues effective July 1, 2008.

In the midst of our failing contract negotiations, we heard rumors that NAADAC had planned on conducting a "town hall" meeting with our members and had not informed CAADAC's leadership. When I saw NAADAC's Executive Director and President at the NAATP conference in Palm Springs two days prior to when the town hall meeting was to be conducted, I confronted them about it. They blamed the NAADAC office and stated notification should have gone out by then. Not more than a couple of hours later, I received notification via an e-blast, which went out to our entire membership. (On a side note, not a single member of CAADAC showed for the meeting except the host, and NAADAC never showed either stating they got lost.)

AB 1367 Update
We are very sad to inform you that our bill did not make it out of appropriations.  However, please be informed: this is not just another failed CAADAC licensure bill!   We want to let you know that along with the incredibly skillful guidance of our lobbyist, Willie Guerrero, at Kahn, Soares and Conway, your legislative committee removed all of the influential opposition to the bill and, if it weren't for the dismal financial situation of California, all indications were that licensure would have become law this year.  To let you know just how dismal the financial situation is, there were about 68 bills heard in the Assembly Appropriations Committee on Thursday, the cost of which totaled about 6 billion dollars.  Only about 20 bills passed -- with a total price tag to the state of 1.5 million! CAADAC Press Release: The War on Addiction: Untrained, Unskilled and Unethical Counselors Jeopardize Lives, Health and Recovery

For Immediate Release: October 25, 2007, Martinez, California.

The California Association of Alcoholism and Drug Abuse Counselors, CAADAC, has reviewed, The War on Addiction: Untrained, Unskilled and Unethical Counselors Jeopardize Lives, Health and Recovery, which was released today by the Justin Foundation. CAADAC President Bob Tyler considers the report to be an alarming reminder of California’s failure to adequately protect addicts seeking addiction treatment in the state and urgently requests that state law makers and regulators respond with reforms that will address the problems brought out by the report. 

“The atrocities in this report are further evidence of the lack of adequate safeguards in state law and regulations governing this critical profession.” said Tyler. “The legislature must step in to ensure that all those suffering from the life-threatening diseases of alcohol and drug addiction receive treatment from counselors who have adequate training and experience. We need to act now so such tragedies can be minimized. It is unfortunate that current regulation allows someone with no education or training to hang out a shingle and treat this disease behind closed doors in a private practice setting.”
